1. Acceptance of Terms

By creating an account, accessing, or using FareCat, you confirm that you are at least 18 years of age (or the age of legal majority in your jurisdiction) and that you accept and agree to be bound by these Terms and our Privacy Policy.

We may update these Terms from time to time. When we make material changes, we will notify you via the email address associated with your account or by posting a prominent notice on our website. Your continued use of the Service after such notice constitutes your acceptance of the updated Terms.

2. Description of Service

FareCat is a fare monitoring service that tracks airline prices for user-specified routes and sends email alerts when fares drop. The Service includes free and paid subscription tiers with varying features.

Important: FareCat does not sell airline tickets, act as a travel agent, or guarantee any fare prices. We provide fare information and alerts as a convenience tool. Fare availability and pricing are determined solely by airlines and may change at any time without notice.

3. User Accounts

• You must provide a valid email address and accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
• You must not share your account with others or create multiple accounts for the purpose of circumventing plan limits.
• You agree to notify us immediately at hello@farecat.com if you suspect any unauthorized use of your account.

4. Subscription Plans & Billing

• Free Plan: Available at no cost with limited features. No credit card is required.
• Paid Plans: Paid subscriptions are billed monthly. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
• Price Changes: We may change our pricing at any time. If we do, we will give you at least 30 days' notice before the new pricing takes effect on your account.
• Cancellation: You may cancel your subscription at any time from your account dashboard. Access to paid features will continue through the end of your current billing period.
• Refunds: We offer a 14-day money-back guarantee for new paid subscriptions. Beyond that, fees are non-refundable except where required by law.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse engineer, decompile, or disassemble any part of the Service.
• Use automated scripts, bots, or scrapers to access the Service beyond its intended interface.
• Interfere with or disrupt the Service or its underlying infrastructure.
• Resell, redistribute, or commercially exploit fare data obtained from the Service without our written consent.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

6. Intellectual Property

The FareCat name, logo, mascot (Captain Whiskers), website design, and all related content are the intellectual property of FareCat and are protected by copyright, trademark, and other intellectual property laws. You may not use our branding, content, or materials without prior written permission.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, FareCat disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• Fare information will be accurate, complete, or current at all times.
• Any particular fare will be available when you attempt to book.

8. Limitation of Liability

To the maximum extent permitted by applicable law, FareCat and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to FareCat in the twelve (12) months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms or are using the Service in a manner that could harm FareCat or other users. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will survive, including but not limited to intellectual property, disclaimers, and limitations of liability.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.
